Yacht-owning buyers considering Continuum Club & Residences North Bay Village should distinguish general waterfront access from a documented slip right, verify vessel and route compatibility, and review costs, operating rules, insurance obligations and transfer terms before closing.
For a yacht owner considering Continuum Club & Residences North Bay Village, the central issue is not simply whether the property is waterfront. The purchase documents should explain whether the residence receives general marina privileges, access to a shared landing area, eligibility to request dockage or a specific right to use a slip.
These arrangements are not interchangeable. A boating amenity may offer convenience without guaranteeing exclusive, continuous or transferable berth access. Before closing, the buyer should identify the exact right attached to the residence and confirm that the purchase agreement and governing documents describe it consistently.
Counsel should review every document governing the residence and any associated boating facilities. The review should determine whether access is deeded, assigned, leased, licensed, membership-based, reservation-based or subject to later approval.
If availability is limited, the documents should explain the allocation method. Buyers should ask whether priority depends on residence ownership, a separate agreement, a waitlist, reservation timing or operator discretion. They should also determine who can modify the rules, reassign access or suspend privileges.
Transferability deserves separate attention. The documents should state whether a boating right follows the residence upon resale, requires approval, can be transferred independently or ends when ownership changes. A buyer should not infer long-term dockage rights from general amenity language.
A yacht may be unsuitable for a facility even when its length appears acceptable. Written confirmation should address length overall, beam, draft, air draft, displacement and projecting equipment. The review should also account for tenders, platforms, pulpits, outboards and other components that affect the vessel’s working dimensions.
Operating rules can be equally important. Buyers should clarify permitted arrival and departure procedures, loading access, guest and crew entry, contractor access, overnight use, liveaboard restrictions, tender storage and any limits on charter or commercial activity. Utility availability, waste procedures, repair restrictions and dock-service hours should also be documented when relevant to the owner’s intended use.
Slip compatibility is only one part of marine access. The owner and captain should evaluate the intended route between the property, open water and regular destinations, using current official navigation information and the yacht’s actual loaded dimensions.
That analysis should account for bridges, channels, tides, water levels, maneuvering space and operating conditions. Conditions can change, so route feasibility should be verified independently rather than assumed from a sales description or map.
The buyer should request a complete written schedule of charges connected with boating access. Depending on the governing arrangement, relevant items may include slip charges, membership dues, utilities, service fees, deposits, assessments, insurance costs and transfer charges.
Responsibility should also be clear. The documents should identify who handles approvals, rule enforcement, maintenance coordination, emergency procedures and storm preparation. Insurance provisions should be reviewed for required limits, evidence of coverage, additional insured parties and responsibility for damage involving the vessel or facility.
Nearby options such as Shoma Bay North Bay Village, Tula Residences North Bay Village and Onda Bay Harbor can be evaluated through the same framework. The useful comparison is not which property uses the strongest waterfront imagery, but which executed documents best match the buyer’s vessel, operating habits, budget and resale objectives.
A disciplined review aligns the purchase agreement, governing instruments, boating rules and any separate access agreement. Any provision material to the acquisition should be written clearly enough for the buyer, counsel, captain and insurance adviser to evaluate before closing.
Does waterfront ownership automatically include a yacht slip? No. The governing documents must identify whether the residence receives a specific slip right or only general access to a boating amenity.
Which documents should counsel review? Counsel should review the purchase agreement, governing instruments, boating rules and any separate membership, license, lease or assignment agreement applicable to access.
What vessel measurements matter? Buyers should verify length overall, beam, draft, air draft, displacement and all projecting equipment against written facility limits.
Why should the captain review the route? The captain can assess whether the yacht’s actual dimensions and operating needs are compatible with bridges, channels, water levels and maneuvering conditions.
Can boating access depend on a waitlist or reservation? It can if the governing arrangement allows it. The allocation method, priority rules and operator discretion should be confirmed in writing.
Should crew and contractor access be addressed? Yes. Entry procedures, credentials, work restrictions and service hours can affect day-to-day yacht operations.
What recurring costs should a buyer investigate? Relevant charges may include access fees, dues, utilities, services, deposits, assessments, insurance expenses and transfer fees.
Are charter and commercial uses automatically permitted? No. Buyers should review all applicable governing rules and obtain written clarification for any intended charter or commercial activity.
Will a boating right transfer when the residence is sold? Transfer should never be assumed. The documents should state whether the right follows the residence, requires approval or terminates upon resale.
What should be resolved before closing? The buyer should resolve the legal basis of access, vessel fit, route feasibility, operating limits, costs, insurance duties and transfer terms.
